Establishing a limited immunity from personal liability for clinicians may lead to less protection of the constitutional rights of patients, whereas increasing malpractice liability for clinical practices may contribute to the protection of patients' constitutional rights. Further, the statutes governing mental health practices may be effective in protecting the rights of patients because they can spell out the requirements of practice in an area where rights violations may be common.
